Terms of Use

Welcome to Omahelper. These Terms of Use ("Terms") are a binding agreement between you and Omahelper ("Omahelper," "we," "us," or "our") governing your access to and use of omahelper.com and any related pages, forms and communications (together, the "Site"). By using the Site, requesting a quote, submitting a service request, applying as a provider, or otherwise interacting with Omahelper, you agree to these Terms. If you do not agree, do not use the Site.

1. What Omahelper is — and is not

Omahelper is a local referral and connection platform. Our only role is to help homeowners and other customers in the Omaha metro ("customers," "you") find and connect with independent, third-party service providers ("providers" or "pros") such as handymen, cleaners, lawn-care crews, movers and similar trades.

Omahelper is not a contractor, home-services company, employer, agent, broker or partner of any provider. We do not perform, supervise, direct, schedule, inspect, price, warrant or guarantee any work. We are not a party to, and take no part in, any agreement, transaction, payment or dispute between a customer and a provider. Every service arrangement — including scope, price, scheduling, quality, payment and any warranty — is solely and directly between the customer and the provider.

2. The relationship is between you and the provider

When you connect with a provider through Omahelper, you are hiring that independent business directly. The provider — not Omahelper — is solely responsible for the services it agrees to perform, for the results of that work, for its own employees and subcontractors, for its own licensing, registration, insurance, tools and conduct, and for compliance with all applicable laws. Any contract you form is with the provider alone. Omahelper does not receive, hold or process payment for provider services, and we are not responsible for collecting, refunding or mediating any amount owed between you and a provider.

You acknowledge that Omahelper does not control and is not responsible for the acts, omissions, timeliness, workmanship, safety, honesty or legal compliance of any provider or customer.

3. Vetting and verification — limits

We make reasonable efforts to gather basic business information from providers at onboarding and may reference publicly available records. However, we do not independently guarantee, and cannot guarantee, any provider's licensing, registration, insurance, bonding, background, qualifications, ongoing status, quality or conduct. Certain trades in Nebraska must register with the Nebraska Department of Labor under the Nebraska Contractor Registration Act, and some work requires a license or permit; registration or listing on our Site is not a substitute for, and does not confirm, any such credential.

Before any work begins, you are responsible for confirming a provider's current license, registration, insurance and references directly with the provider and with the relevant authorities. Words like "vetted," "trusted" or "local pros" describe our general onboarding approach and customer feedback — they are not a certification, guarantee or warranty of any provider.

4. Pricing and estimates

Any price ranges, averages or estimates shown on the Site are general, non-binding guidance based on typical Omaha-area jobs. They are not quotes, bids or offers, and they do not bind Omahelper or any provider. Only the provider you choose can give you an actual quote, and final pricing, terms and scope are set entirely between you and that provider.

5. Eligibility and acceptable use

You must be at least 18 years old and able to form a binding contract to use the Site. You agree to provide accurate, current and complete information; to use the Site only to request or offer legitimate services; and not to misuse the Site. You will not: submit false, fraudulent or misleading information; harvest or scrape data; upload malware; harass or defraud other users; infringe anyone's rights; or use the Site for any unlawful purpose. We may refuse, remove, suspend or terminate any request, listing, account or user at our discretion and without notice.

6. Communications and text messages

When you submit a request, you authorize Omahelper and the providers we share your request with to contact you by phone, email and/or text message about that request, using the contact details you provide. If you opt in to text messages, message and data rates may apply, message frequency varies, and you can opt out at any time by replying STOP or unsubscribe from emails at any time. Consent to receive messages is not a condition of any purchase. See our Privacy Policy for details on how we handle your information.

7. Reviews, submissions and content

If you submit reviews, ratings, photos or other content, you represent that it is accurate, yours to share, and not unlawful or misleading, and you grant Omahelper a non-exclusive, royalty-free, worldwide license to use, display and distribute that content in connection with operating and promoting the Site. We may edit or remove content at our discretion. Deceptive or fake reviews are prohibited.

8. Intellectual property

The Site, including its name, logo, text, design and organization, is owned by Omahelper or its licensors and is protected by law. You may not copy, reproduce or create derivative works from the Site without our written permission, except for your own personal, non-commercial use.

9. Disclaimer of warranties

THE SITE AND ALL REFERRALS, LISTINGS, ESTIMATES AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. OMAHELPER DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY PROVIDER OR SERVICE WILL MEET YOUR EXPECTATIONS. OMAHELPER MAKES NO WARRANTY REGARDING ANY PROVIDER, ANY WORK PERFORMED, OR THE CONDUCT OF ANY USER.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OMAHELPER AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, PROPERTY, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO: (a) THE SERVICES, WORK, ACTS OR OMISSIONS OF ANY PROVIDER; (b) ANY AGREEMENT, DISPUTE, PAYMENT, INJURY, DAMAGE OR LOSS BETWEEN A CUSTOMER AND A PROVIDER; (c) YOUR USE OF, OR INABILITY TO USE, THE SITE; OR (d) ANY CONTENT OR INFORMATION ON THE SITE. THIS APPLIES REGARDLESS OF THE LEGAL THEORY AND EVEN IF OMAHELPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE OMAHELPER IS ONLY A CONNECTION PLATFORM AND IS NOT A PARTY TO THE SERVICE RELATIONSHIP, IN NO EVENT WILL OMAHELPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SITE OR THESE TERMS EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU PAID TO OMAHELPER (NOT TO A PROVIDER) IN THE 12 MONTHS BEFORE THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Release

Because Omahelper's role is limited to connecting customers and providers, you release Omahelper and its owners, officers, employees and agents from any and all claims, demands, damages, losses and liabilities of every kind — known or unknown — arising out of or in any way connected with a dispute, transaction, injury, property damage or interaction between you and a provider or any other user. If you are a California resident, you waive California Civil Code Section 1542; where similar laws apply elsewhere, you waive them as well.

12. Indemnification

You agree to defend, indemnify and hold harmless Omahelper and its owners, officers, employees and agents from any claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or any service arrangement, transaction or dispute between you and a provider or another user.

13. Third-party links and content

The Site may link to or display third-party websites, tools or content. We do not control and are not responsible for third-party sites or content, and linking does not imply endorsement.

14. Governing law and disputes

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law rules. Except where prohibited, you agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Douglas County, Nebraska, and you consent to their jurisdiction and venue. Nothing in these Terms limits any rights you may have under the Nebraska Consumer Protection Act, the Nebraska Uniform Deceptive Trade Practices Act, or other laws that cannot be waived by agreement.

15. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date above will reflect the most recent version. Your continued use of the Site after changes are posted means you accept the updated Terms.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice. Sections that by their nature should survive termination — including disclaimers, limitation of liability, release, indemnification and governing law — will survive.

17. Miscellaneous

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Omahelper regarding the Site and supersede any prior understandings. You may not assign these Terms; we may.
